Pourquoi la connectivit\u00e9 a\u00e9rienne de la Cara\u00efbe d\u00e9pend encore des accords bilat\u00e9raux"},"content":{"rendered":"\n<p>La connectivit\u00e9 a\u00e9rienne de la Cara\u00efbe continue de fonctionner dans un cadre juridique largement fond\u00e9 sur des accords bilat\u00e9raux n\u00e9goci\u00e9s entre \u00c9tats, dont les bases remontent au d\u00e9veloppement de l\u2019aviation civile internationale apr\u00e8s-guerre.<\/p>\n\n<p>La question figurait parmi les th\u00e8mes abord\u00e9s lors du <a href=\"https:\/\/www.latitude-15.com\/fr\/un-seminaire-juridique-de-leccaa-met-en-lumiere-les-defis-de-la-connectivite-aerienne-dans-la-caraibe\/\">Premier s\u00e9minaire juridique sur les cadres juridiques \u00e9mergents en aviation civile, organis\u00e9 par l\u2019Autorit\u00e9 de l\u2019aviation civile de la Cara\u00efbe orientales les 13 et 14 novembre 2025<\/a> \u00e0 Antigua-et-Barbuda. Les pr\u00e9sentations faites lors de l\u2019\u00e9v\u00e9nement ont examin\u00e9 les m\u00e9canismes juridiques et r\u00e9glementaires r\u00e9gissant le transport a\u00e9rien international, notamment le r\u00f4le toujours d\u00e9terminant des accords de services a\u00e9riens dans la structuration de la connectivit\u00e9 a\u00e9rienne r\u00e9gionale. <\/p>\n\n<h2 class=\"wp-block-heading\">Le syst\u00e8me d\u2019apr\u00e8s-guerre qui fa\u00e7onne encore l\u2019aviation internationale<\/h2>\n\n<p>Dans une pr\u00e9sentation intitul\u00e9e <em>\u00ab <strong>Introduction aux accords de services a\u00e9riens<\/strong> \u00bb<\/em>, l\u2019ambassadeur Brian Challenger, du minist\u00e8re de l\u2019Aviation civile d\u2019Antigua-et-Barbuda, a retrac\u00e9 les origines du syst\u00e8me bilat\u00e9ral de l\u2019aviation encore en vigueur aujourd\u2019hui.<\/p>\n\n<p>Selon la pr\u00e9sentation, ce cadre est apparu \u00e0 la suite de l\u2019adoption de la <strong>Convention de Chicago de 1944<\/strong>, qui a \u00e9tabli les fondements techniques et institutionnels de l\u2019aviation civile internationale. Si la convention a cr\u00e9\u00e9 un cadre r\u00e9glementaire commun pour des domaines tels que la navigation et la d\u00e9livrance de licences, les \u00c9tats ne sont pas parvenus \u00e0 s\u2019accorder sur un \u00e9change multilat\u00e9ral mondial des droits de trafic. <\/p>\n\n<p>En cons\u00e9quence, l\u2019attribution des droits commerciaux de trafic a\u00e9rien a \u00e9volu\u00e9 principalement au travers de n\u00e9gociations bilat\u00e9rales entre gouvernements, donnant naissance au syst\u00e8me des accords de services a\u00e9riens qui continue de r\u00e9gir aujourd\u2019hui la plupart des liaisons a\u00e9riennes internationales.<\/p>\n\n<h2 class=\"wp-block-heading\">Pourquoi les accords de services a\u00e9riens restent importants<\/h2>\n\n<p>Les accords de services a\u00e9riens d\u00e9finissent les conditions juridiques dans lesquelles les compagnies a\u00e9riennes peuvent op\u00e9rer entre pays. Ces accords couvrent g\u00e9n\u00e9ralement des aspects tels que les transporteurs d\u00e9sign\u00e9s, les droits de route, les fr\u00e9quences, la capacit\u00e9, les modalit\u00e9s tarifaires et les dispositions op\u00e9rationnelles. <\/p>\n\n<p>Les accords fixent \u00e9galement des conditions relatives \u00e0 la propri\u00e9t\u00e9 et au contr\u00f4le effectif des compagnies a\u00e9riennes, tout en incluant des dispositions portant sur les obligations en mati\u00e8re de s\u00fbret\u00e9 et de s\u00e9curit\u00e9 de l\u2019aviation entre \u00c9tats.<\/p>\n\n<p>Les n\u00e9gociations de ces accords impliquent g\u00e9n\u00e9ralement un large \u00e9ventail de parties prenantes, notamment les autorit\u00e9s de l\u2019aviation civile, les minist\u00e8res des Affaires \u00e9trang\u00e8res, les exploitants d\u2019a\u00e9roports, les compagnies a\u00e9riennes et les organismes de tourisme.<\/p>\n\n<p>La pr\u00e9sentation a \u00e9galement indiqu\u00e9 que, dans certaines situations o\u00f9 aucun accord formel de services a\u00e9riens n\u2019existe, les \u00c9tats peuvent s\u2019appuyer sur des protocoles d\u2019accord ou des arrangements techniques afin d\u2019apporter une s\u00e9curit\u00e9 juridique aux op\u00e9rations de services a\u00e9riens.<\/p>\n\n<h2 class=\"wp-block-heading\">Efforts de lib\u00e9ralisation et mod\u00e8les r\u00e9gionaux<\/h2>\n\n<p>Le s\u00e9minaire a \u00e9galement mis en \u00e9vidence la mani\u00e8re dont les approches de la lib\u00e9ralisation de l\u2019aviation ont \u00e9volu\u00e9 au fil du temps.<\/p>\n\n<p>L\u2019<em>accord des Bermudes de 1946 entre<\/em> les \u00c9tats-Unis et le Royaume-Uni a \u00e9tabli l\u2019un des premiers mod\u00e8les d\u2019accords bilat\u00e9raux en mati\u00e8re d\u2019aviation, fond\u00e9 sur des attributions strictement r\u00e9glement\u00e9es des droits commerciaux et de la capacit\u00e9.<\/p>\n\n<p>Ce cadre a encore \u00e9volu\u00e9 avec l\u2019<strong>accord Bermuda II de 1977<\/strong>, qui a introduit des approches plus lib\u00e9ralis\u00e9es concernant les droits de route, l\u2019allocation de capacit\u00e9 et la tarification. Selon la pr\u00e9sentation, les \u00e9volutions ult\u00e9rieures ont contribu\u00e9 aux accords d\u2019aviation plus lib\u00e9ralis\u00e9s couramment utilis\u00e9s aujourd\u2019hui. <\/p>\n\n<p>Plusieurs mod\u00e8les multilat\u00e9raux ont \u00e9galement \u00e9t\u00e9 \u00e9voqu\u00e9s lors du s\u00e9minaire. Il s\u2019agissait notamment de l\u2019<strong>accord multilat\u00e9ral de services a\u00e9riens de la CARICOM (MASA)<\/strong>, con\u00e7u pour soutenir la coop\u00e9ration a\u00e9ronautique r\u00e9gionale au sein de la Communaut\u00e9 des Cara\u00efbes, ainsi que de l\u2019<strong>accord multilat\u00e9ral sur la lib\u00e9ralisation du transport a\u00e9rien international (MALIAT)<\/strong> impliquant les \u00c9tats-Unis et des pays du pourtour du Pacifique. <\/p>\n\n<p>La pr\u00e9sentation a identifi\u00e9 l\u2019Union europ\u00e9enne comme l\u2019exemple le plus avanc\u00e9 d\u2019un march\u00e9 a\u00e9rien int\u00e9gr\u00e9, combinant la r\u00e9glementation commerciale et technique entre les \u00c9tats membres.<\/p>\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.latitude-15.com\/wp-content\/uploads\/2026\/05\/gallery_55-1024x683.jpg\" alt=\"\" class=\"wp-image-23650\" srcset=\"https:\/\/www.latitude-15.com\/wp-content\/uploads\/2026\/05\/gallery_55-1024x683.jpg 1024w, https:\/\/www.latitude-15.com\/wp-content\/uploads\/2026\/05\/gallery_55-300x200.jpg 300w, https:\/\/www.latitude-15.com\/wp-content\/uploads\/2026\/05\/gallery_55-768x512.jpg 768w, https:\/\/www.latitude-15.com\/wp-content\/uploads\/2026\/05\/gallery_55-1536x1024.jpg 1536w, https:\/\/www.latitude-15.com\/wp-content\/uploads\/2026\/05\/gallery_55-2048x1366.jpg 2048w, https:\/\/www.latitude-15.com\/wp-content\/uploads\/2026\/05\/gallery_55-1320x880.jpg 1320w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n<h2 class=\"wp-block-heading\">D\u00e9fis de connectivit\u00e9 dans des march\u00e9s insulaires fragment\u00e9s<\/h2>\n\n<p>L\u2019importance persistante des accords bilat\u00e9raux refl\u00e8te la complexit\u00e9 plus large de la connectivit\u00e9 a\u00e9rienne dans les r\u00e9gions insulaires, o\u00f9 plusieurs juridictions interagissent sur des march\u00e9s relativement restreints.<\/p>\n\n<p>Lors du s\u00e9minaire de l\u2019ECCAA, les \u00e9changes sur la connectivit\u00e9 carib\u00e9enne ont mis en lumi\u00e8re le r\u00f4le de l\u2019aviation dans le soutien \u00e0 la mobilit\u00e9, au tourisme et aux \u00e9changes \u00e9conomiques dans la r\u00e9gion. Les pr\u00e9sentations ont \u00e9galement soulign\u00e9 l\u2019importance de la coop\u00e9ration r\u00e9glementaire et de la coordination institutionnelle pour maintenir des syst\u00e8mes de transport a\u00e9rien r\u00e9gional efficaces. <\/p>\n\n<p>Le cadre juridique r\u00e9gissant l\u2019aviation internationale demeure donc \u00e9troitement li\u00e9 aux n\u00e9gociations diplomatiques et \u00e0 la coop\u00e9ration intergouvernementale, en particulier dans les r\u00e9gions o\u00f9 la connectivit\u00e9 du transport a\u00e9rien d\u00e9pend fortement de la coordination transfrontali\u00e8re.<\/p>\n\n<h2 class=\"wp-block-heading\">Les accords bilat\u00e9raux restent au c\u0153ur de l\u2019aviation r\u00e9gionale<\/h2>\n\n<p>Les discussions lors du <em>s\u00e9minaire juridique de l\u2019ECCAA<\/em> ont illustr\u00e9 comment l\u2019aviation internationale continue de fonctionner dans une architecture juridique largement fa\u00e7onn\u00e9e par des accords bilat\u00e9raux et multilat\u00e9raux entre \u00c9tats.<\/p>\n\n<p>Si les efforts de lib\u00e9ralisation et les initiatives de coop\u00e9ration r\u00e9gionale se sont d\u00e9velopp\u00e9s dans plusieurs parties du monde, les accords de services a\u00e9riens demeurent un m\u00e9canisme central r\u00e9gissant l\u2019acc\u00e8s au march\u00e9, les droits d\u2019exploitation et la supervision r\u00e9glementaire sur les march\u00e9s de l\u2019aviation carib\u00e9enne.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La connectivit\u00e9 a\u00e9rienne de la Cara\u00efbe continue de fonctionner dans un cadre juridique largement fond\u00e9 sur des accords bilat\u00e9raux n\u00e9goci\u00e9s entre \u00c9tats, dont les bases remontent au d\u00e9veloppement de l\u2019aviation civile internationale apr\u00e8s-guerre.
